Terms and Conditions of Sale

1. Guarantee: The Real Factory Shop (RFS) guarantees that all products contained in our hampers and gifts are of the highest quality, that all manufacturers/suppliers have signed Certificates of Assurance that their products meet current EU legislation standards, and that the products meet the required standards for the purpose for which they were intended.

2. Payment: We accept all major credit and debit cards (no minimum) and we use a secure payment system (SecPay) in association with Barclays plc and Secure Hosting Ltd. This means that your credit card details will be encrypted before transmission (using a powerful security code).

3. Value Added Tax (VAT): VAT is included in the cost of each hamper, where applicable (VAT number GB 571 552 832).

4. Order Confirmation: When you submit an order using our automated shopping basket system and pay through the secure payment system, you will receive two e-mails. An 'Order Confirmation' from RFS and a 'Transaction Authorised' from SecPay.

5. Delivery: All prices shown include delivery within the United Kingdom by Parcelforce 48 (2 working days). RFS will make every effort to despatch orders within 2 working days of receipt. All mail order gifts are packaged in strong, approved outer containers. All hampers must be signed for and goods remain the property of RFS until paid for in full.

6. Recipient Details: Please make sure that all addresses are accurate and include the postal town and postal code, together with the recipient's telephone number. This enables us and the carriers to speedily and accurately deliver your gifts. You may incur extra delivery charges if you give us inaccurate details, and you may delay the delivery. Our guarantee is limited to delivering to the building you specify, not to individual recipients.

7. Claims: We make every effort to ensure hampers and gifts arrive in perfect condition. In the unlikely event of damage or loss in transit, your gifts are fully insured and we will replace the damaged contents or gift free of charge providing:
(a) the goods are signed for upon receipt as either 'damaged' or 'unexamined'
(b) The carrier and ourselves are informed at once and it is confirmed by the recipient to us in writing within three days of delivery quoting the reference number on the parcel
(c) Damaged goods must be retained for inspection and we may ask for them to be returned to us at our expense before replacement or refund.
Returned goods must clearly show the full name and address of the sender. Our liability is limited to the selling price of the goods in all cases.

8. Refunds: Refunds for valid claims will be made via the same method of payment used to place the order.

9. Substitutions: We hold ample stock of most items included in our hampers, but occasionally we may need to substitute items of an equal or higher value should the need arise.

10. Data Protection: All customer details submitted to RFS remain confidential to the company. We are committed to protecting your privacy and will only use the information that we collect about you in accordance with the Data Protection Act 1998 for two reasons: firstly, to process your order and secondly, to provide you with the best possible service. 11. Liability: Our liability is limited to the guarantee of our suppliers and any consequential losses are limited to the purchase price paid to RFS.
